Practice Areas

WE REPRESENT BROKERS AND SALESPERSONS AS WELL AS THOSE APPLYING FOR A NEW LICENSE.

Areas of Expertise:

  • Statement of Issues (applies to the denial of an application for licensure).
  • Accusation (applies to the discipline of a license or license rights).
  • Desist and Refrain Orders (issued, for example, when a party is accused in engaging in unlicensed activity).
  • Other areas of representation.

In all of the above, there is a right to have the matter heard in a formal hearing conducted by an administrative law judge of the Office of Administrative Hearings. We recommend you only appear at such hearings with counsel experienced in administrative and licensing law.

Audits:

We also provide regulatory compliance reviews to help you survive a California Department of Real Estate (DRE) audit of your books and records. If you have not had your operation reviewed within the past 12 months, you should consider undergoing a compliance review to make sure that your business is in full compliance. Broker escrow activity and property management services, because they involve the handling of trust funds, are areas which require robust compliance procedures. These activities are the subject of close scrutiny by the CA DRE.

Representing You in Your Licensing Matter:

We will conduct discovery to assess the strength of the allegations against your license, evaluate the evidence that is both good and bad for your case and make settlement recommendations if appropriate.  If settlement is not possible, we will prepare the case for administrative trial.

Petition Matters:

We also handle Petition matters before the California Department of Real Estate.
